
BELLY’S BUDGET BINS
SKIP BIN HIRE — TERMS AND CONDITIONS
These terms and conditions (the Terms) govern the hire of skip bins by Belly’s Budget Bins Pty Ltd (ABN 61 442 147 606) of (Belly’s Budget Bins, we, us or our) and any person or business that books a skip bin from us (Customer, you or your).
You accept these Terms in full as soon as you: place a booking with us (online, by phone or in person); accept delivery of a bin; or sign any invoice or docket we issue. Please read them before booking, as they set out what happens if something goes wrong, who pays for what, and what you can and can’t put in the bin.
1. Definitions
Additional Charges means extra fees we may charge you where the Bin is overfilled, loaded above its fill line, exceeds a weight limit specified in your Booking, contains Restricted Items, is kept longer than the agreed Hire Period, or where we incur council fees, fines or clean-up costs because of how the Bin was used.
Bin means the skip bin (and any associated equipment) supplied to you as part of the Services.
Booking means the order for Services confirmed by us, whether made through our Website, by phone, or in writing, including the Bin size, Hire Period, Site and Fees agreed at that time.
Fees means the delivery, hire, collection and disposal charges payable for the Services, together with any Additional Charges.
Hire Period means the period stated in your Booking for which the Bin is hired to you. Our standard Fee includes up to 14 days on Site; any extension beyond that period may incur Additional Charges and is subject to availability.
Restricted Items means the waste types listed in clause 5.5 (or otherwise notified to you) that must not be placed in the Bin.
Services means the delivery, hire and collection of a Bin, and disposal of the waste it contains, as agreed in your Booking.
Site means the address nominated by you for delivery and collection of the Bin.
Website means www.bellysbudgetbins.com.au.
2. Our Services
2.1 We will deliver, and later collect, a Bin of the size and for the Hire Period set out in your Booking, and dispose of the waste it contains in accordance with applicable law.
2.2 Delivery and collection windows are estimates only. We’ll do our best to meet the time you request, but delays caused by traffic, weather, access issues or matters outside our reasonable control won’t make us liable to you.
2.3 We may decline to deliver, or may remove, a Bin (without it counting as a breach of these Terms) if: the Site is unsafe or inaccessible; the ground won’t safely support a loaded Bin and delivery vehicle; the Bin has been overloaded or contains Restricted Items; you haven’t paid the Fees; or we reasonably believe continuing would breach the law or put anyone at risk.
2.4 We may inspect the contents of a Bin before collection or disposal. If we find Restricted Items, we may charge you for their safe removal and disposal, or leave them at the Site for you to remove yourself, at our discretion.
2.5 Once collected, ownership of the waste in the Bin passes to us. Ownership of any Restricted Items you were asked to remove remains with you until it is lawfully disposed of.
3. Fees and Payment
3.1 Fees are those quoted to you at Booking, and are only guaranteed for the scope described in that Booking (bin size, waste type, Hire Period and Site).
3.2 Payment is required on or before delivery, unless we’ve agreed a different arrangement with you in writing.
3.3 We accept cash, credit card and direct debit. We do not accept AMEX, Diners Club, or personal cheques.
3.4 Quoted Fees include GST unless we say otherwise.
3.5 We may charge Additional Charges where clause 1 (definition), 5 or 6 applies, and we’ll try to let you know before doing so where practical.
3.6 If you don’t pay, or refuse to pay, for the Services, we may return the Bin’s contents to the Site (or other location) from which they came, in addition to any other rights we have under these Terms or at law.
3.7 We may change our standard pricing at any time; a price change won’t affect a Booking you’ve already confirmed and paid for.
4. Cancellations and Changes
4.1 You may cancel or reschedule a delivery free of charge up to 24 hours before the scheduled delivery time.
4.2 Cancellations made with less than 24 hours’ notice may incur a cancellation fee to cover costs already committed (such as employee and or vehicle scheduling).
4.3 Collection must also be arranged at least 24 hours in advance and is subject to availability.
4.4 If a Bin has already been delivered, collection and disposal fees remain payable even if you cancel the remainder of the Hire Period.
4.5 We may cancel or reschedule a Booking, acting reasonably, where the Site becomes inaccessible or unsafe, where required Restricted Item information wasn’t provided, or for reasons beyond our control (see clause 15). Where we cancel for these reasons, we’ll refund any Fees paid for Services not provided.
5. Using the Bin — Your Responsibilities
5.1 You are responsible for making sure the Site can safely bear the weight of our delivery vehicle and a fully loaded Bin, and that there is safe, clear access (we recommend a minimum of 3 metres of unobstructed width).
5.2 If you want the Bin placed on a public road, footpath or nature strip, you must obtain any required council permit before delivery, the responsibility to hold a valid permit is yours. You agree that any fines or penalties incurred by placement of bin by direction or request will be solely liable and payable to the hirer and not us,
5.3 The Bin may only be filled to the rim. This is a safety requirement for our drivers and other road users, and also helps keep our costs — and therefore your Fees — as low as possible. Overfilled Bins may be refused collection, or Additional Charges may apply; please contact us before pick-up if you’re concerned a Bin may be overfilled.
5.4 You may place the following in the Bin:
general household items
vegetation
construction material waste
landscaping materials
home renovation materials
empty paint tins only
electrical equipment (TVs, printers, scanners, game consoles etc.)
brick, concrete and tiles
clean soil (VENM) that contains no other material
rubble — a mixture of soil, sand, asphalt and rock, with up to 30% clay per cubic metre
If you’re unsure whether an item can go in the Bin, please contact us before your Booking — Additional Charges may apply to items we haven’t been told about in advance.
5.5 The following must not be placed in the Bin under any circumstances (Restricted Items):
asbestos, or waste containing or contaminated with asbestos
liquids
food waste
human waste or nappies
medical waste, including sharps such as needles
gas bottles
household and cleaning chemicals
herbicides and pesticides
motor oil
palm tree trunks or stumps
synthetic grass
wet concrete or concrete slurry
If asbestos, or waste containing or contaminated with asbestos, is found in a Bin, a reload fee will appliy, as well as additional payments and requirements that must be followed due to being contaminated…
Additional Charges will apply to any other Restricted Item found in a Bin, whether or not it was concealed within other waste — if you need help disposing of any of the above, let us know and we’ll assist where we can.
5.6 The following items are only accepted with our prior approval, and Additional Charges apply if we agree to take them:
mattresses
vehicle tyres of any type
fridges, freezers and air conditioners (gassed or ungassed)
batteries
fire extinguishers
tree stumps or trunks over 300mm
paint tins containing liquid paint
Please contact us before your Booking if you have any of the above — placing them in the Bin without our prior approval, including concealed within other waste, will still incur Additional Charges.
5.7 You’re responsible for keeping the Site safe around the Bin for the Hire Period, including at night, and for any loss or damage caused by items placed on, in, or around the Bin by you or anyone else at the Site.
5.8 You must not move, relocate or interfere with the Bin once delivered.
5.9 Where a Bin has a weight limit specified in your Booking, and the waste you place in it exceeds that limit, Additional Charges will apply for the excess weight. We’ll weigh the Bin on collection and calculate any excess weight charge at our standard rate per tonne (or part thereof) over the limit, which we’ll provide to you on request.
6. If We Can’t Deliver on Time
If we’re unable to deliver your Bin on the date confirmed in your Booking for a reason within our control, you can choose to have it delivered as soon as reasonably possible afterwards, or receive a full refund of Fees paid for that Booking. This clause doesn’t limit any other rights you have under the Australian Consumer Law.
7. Our Assurances to You
7.1 We’ll carry out the Services with reasonable care and skill, consistent with standard industry practice.
7.2 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it’s limited (at our option) to re-supplying the Services or paying the cost of having them supplied again.
8. Liability and Indemnity
8.1 To the extent permitted by law, we won’t be liable for indirect or consequential loss, including lost profits, lost opportunity, or business interruption.
8.2 Except for guarantees that can’t be excluded under the Australian Consumer Law, our total liability to you arising out of a Booking is limited to the amount you paid us for that Booking.
8.3 You agree to cover us for any loss, damage, fine or cost we reasonably incur because of: your breach of these Terms; Restricted Items placed in the Bin without our agreement; or damage to the Bin or our vehicles caused by you or someone at the Site (fair wear and tear excepted), except to the extent our own negligence contributed to that loss.
8.4 The Bin remains our property at all times. You must not sell, sub-hire, modify or grant any security interest over it.
9. Sorting Out a Problem
9.1 If a dispute arises, please contact us first on 0450 223 559 or sales@bellysbudgetbins.com.au — most issues can be resolved quickly this way.
9.2 If we can’t resolve things directly within a reasonable time, either of us may refer the dispute to mediation before starting court proceedings, except where urgent interim relief is needed.
10. Ending These Terms
10.1 We may suspend or end the Services and retrieve the Bin if you’re significantly in breach of these Terms (for example, non-payment or repeated misuse) and haven’t fixed the issue within a reasonable time after we’ve asked you to.
10.2 Ending an agreement under these Terms doesn’t affect Fees already owing, or any rights either of us already has.
11. Privacy
Any personal information you give us is handled in line with Privacy Laws
12. Events Beyond Our Control
We’re not liable for any failure or delay in providing the Services caused by events reasonably outside our control (for example, extreme weather, natural disaster, industrial action, or disposal facility closures). If such an event continues for more than 7 days, either of us may end the affected Booking by written notice, and you’ll only be liable for Fees relating to Services already provided.
13. Changes to These Terms
We may update these Terms from time to time; the current version will always be available on the Website and applies to Bookings made after it’s published. Changes won’t affect a Booking you’ve already confirmed.
14. General
14.1 If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply.
14.2 If we don’t enforce a right under these Terms on one occasion, that doesn’t stop us enforcing it later.
14.3 Notices under these Terms should be sent in writing to the contact details above, or to the address/email you provided at Booking.
14.4 These Terms are governed by the laws of New South Wales, and each party submits to the non-exclusive jurisdiction of its courts.
